Terms of service and privacy policy

This document contains both the terms of service and privacy policy for TCLi Academy. Please read each section carefully, as they collectively govern your use of our services and explain how your personal information is collected, used, and protected.

1. Terms of service

These Terms and Conditions ("Terms") govern your use of TCLi Academy and related services provided by The Consulting Lab inc. ("TCLi," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.


1.1 Acceptance and modifications

By using TCLi Academy, you confirm that you are at least 18 years old or have the necessary parental/guardian consent, and that you have the authority to enter into these Terms on behalf of yourself or your organization.


We may modify these Terms at any time. Material changes will be communicated through the platform or via email. Continued use of our services after changes indicates your acceptance of the revised Terms.


1.2 Account registration and security

Age requirements: You must be at least 18 years old to create an account independently. Users between 13-17 years old may access our services only with proper parental, guardian, or institutional supervision and consent.


Prohibited for children under 13: Our services are not available to children under 13 years of age. If we discover an account has been created by someone under 13, we will terminate that account immediately.


Account creation: You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials.

Parental responsibility: If you are a parent or guardian allowing supervised access for a minor (13-17), you:

  • Accept full responsibility for the minor's use of our services
  • Agree to monitor their account activity and interactions
  • May request access to review or delete the minor's information at any time
  • Understand that all communications and agreements are with you as the responsible adult


Account responsibility: You are responsible for all activities that occur under your account. Please notify us immediately of any unauthorized use.

Organizational accounts: If you register on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.


1.3 Acceptable use

Permitted use: Our services are designed to support business consulting, organizational development, and educational activities. You may use the platform to access training materials, participate in community discussions, submit work for AI-powered analysis, and collaborate on projects.


Community standards: When participating in community features, you agree to:

  • Treat other members with respect and professionalism
  • Share content that is relevant and valuable to the community
  • Respect intellectual property rights and properly attribute sources
  • Maintain confidentiality of sensitive business information shared by others


Content moderation: We reserve the right to review, moderate, or remove user-generated content that violates these Terms or community standards. This includes content that is:

  • Inappropriate for a professional learning environment
  • Potentially harmful to minors (if supervised users are present)
  • Spam or off-topic material
  • Violates others' privacy or intellectual property


Prohibited activities: You agree not to:

  • Submit highly sensitive personal data (health records, financial information, government IDs) unless expressly required under contract
  • Use the platform for illegal activities or to violate others' rights
  • Share inappropriate content, including material unsuitable for minors
  • Attempt to reverse engineer, hack, or disrupt our services
  • Share account credentials or allow unauthorized access by minors or others
  • Submit content that is defamatory, harassing, or violates intellectual property rights
  • Collect or harvest other users' personal information
  • Circumvent age restrictions or verification processes


1.4 Content and intellectual property

Your content: You retain ownership of content you submit to our platform. By submitting content, you grant TCLi a license to process, analyze, and provide services related to that content.

Community content: When you post in community areas, you grant other members permission to view and learn from your content within the platform context.


Content standards: All user content must comply with our community standards and be appropriate for a professional educational environment. Content should be suitable for viewing by supervised minors (ages 13-17) who may be present in the community.


AI-generated outputs: Content generated by our AI systems based on your inputs is provided for your use, subject to these Terms and applicable laws. AI outputs may contain errors or reflect biases present in training data, and should not be relied upon as the sole basis for important decisions.


Platform content: All TCLi Academy materials, including courses, frameworks, and methodologies, are protected by intellectual property laws and remain our property or that of our licensors.


Content removal: We may remove content that violates these Terms, poses security risks, or is inappropriate for our community, with or without notice to the user.


1.5 Service availability and modifications

We strive to maintain reliable service but cannot guarantee uninterrupted access. We may:

  • Temporarily suspend services for maintenance or security reasons
  • Modify or discontinue features with reasonable notice
  • Set usage limits to ensure fair access for all users



1.6 Payment and billing

Fees: Current pricing is available on our website. Fees are charged in advance and are non-refundable except as required by law.

Auto-renewal: Subscription services automatically renew unless you cancel before the next billing cycle.

Changes: We may modify pricing with reasonable advance notice to existing subscribers.


1.7 Privacy and data handling

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.


1.8 Disclaimers and limitation of liability

Service "as is": Our services are provided on an "as is" basis. While we strive for accuracy and reliability, we make no warranties about the completeness or accuracy of AI-generated content or platform features.


Educational purpose: Our services are designed to support professional development and should not replace professional judgment or specialized expertise in your specific field.


Limitation of liability: To the fullest extent permitted by law:

  • TCLi's total liability for any claim will not exceed the amount you paid for services in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities
  • These limitations apply regardless of the legal theory and even if we were advised of the possibility of damages


1.9 Indemnification

You agree to indemnify and hold TCLi harmless from claims arising from your use of our services, violation of these Terms, or infringement of others' rights.


1.10 Termination

By you: You may terminate your account at any time through your account settings or by contacting us.


By us: We may suspend or terminate your access if you:

  • Violate these Terms or our community standards
  • Engage in harmful activities or pose security risks
  • Provide false information about age or identity
  • Allow unauthorized access by minors under 13

We will provide reasonable notice except in cases involving security risks, legal requirements, or violations involving minors.


Parental termination: Parents or guardians may request immediate termination of their minor's account at any time by contacting us at admin@theconsultinglab.us.


Effect of termination: Upon termination:

  • Your access to the platform will cease immediately
  • We will begin deletion of your personal information according to our Privacy Policy
  • Certain provisions of these Terms will survive, including intellectual property rights and limitation of liability
  • Any outstanding payment obligations remain due


1.11 Dispute resolution

Governing law: These Terms are governed by the laws of [Insert State/Jurisdiction], without regard to conflict of law principles.


Dispute resolution: We encourage resolving disputes through direct communication. For formal disputes, we prefer binding arbitration over litigation, except for claims that may be brought in small claims court.


1.12 General provisions

Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and TCLi regarding our services.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Assignment: You may not assign these Terms without our written consent. We may assign our rights and obligations under these Terms.



2. Privacy policy

At The Consulting Lab inc. ("TCLi," "we," "us," or "our"), we respect your privacy and are committed to protecting the personal information you share with us through TCLi Academy and our related services.

2.1 What information we collect 

Information you provide directly:


  • Name, email address, and organizational affiliation when you create an account
  • Profile information including job title, company, and professional interests
  • Content you submit through our platform (prompts, documents, project materials, community posts)
  • Communications with our support team and community interactions
  • Payment information (processed securely through third-party providers)
  • Feedback, survey responses, and course evaluations


Information collected automatically:

  • Usage data and platform interactions
  • Device and browser information
  • IP addresses and general location data


2.2 How we use your information

We use the information we collect to:

  • Provide and improve our academy services and AI-powered tools
  • Create and manage user profiles and community access
  • Facilitate learning progress tracking and certification
  • Deliver customer support and respond to your inquiries
  • Send educational content, course updates, and community communications
  • Manage community interactions and moderate content
  • Ensure platform security and prevent misuse
  • Comply with legal obligations
  • Conduct research to improve our educational methodologies


AI processing: Content you provide may be processed by AI systems to generate outputs and improve our services. We do not sell or rent your personal information to third parties for marketing purposes.


2.3 Information sharing and third parties

Service providers: We work with carefully selected third-party providers for essential functions like cloud hosting, payment processing, and AI infrastructure. These partners are contractually required to maintain appropriate privacy and security safeguards.

Legal requirements: We may disclose information when required by law, to protect our rights, or to ensure platform safety.

Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.


2.4 Data security and protection

We implement comprehensive security measures to protect your personal information:

Technical safeguards:

  • Encrypted data transmission using industry-standard protocols
  • Secure data storage with access controls and authentication
  • Regular security assessments and vulnerability testing
  • Firewall protection and intrusion detection systems


Administrative safeguards:

  • Employee training on data privacy and security
  • Limited access to personal information on a need-to-know basis
  • Background checks for personnel with access to sensitive data
  • Regular review and update of security policies


Physical safeguards:

  • Secure facilities with controlled access
  • Protected computer workstations and media storage
  • Secure disposal of physical materials containing personal information


Incident response: If we discover a data breach affecting your personal information, we will:

  • Investigate and contain the incident promptly
  • Notify affected users within 72 hours when feasible
  • Provide clear information about what happened and what we're doing about it
  • Take steps to prevent similar incidents in the future


While we implement these protections, no internet-based service can guarantee absolute security, and you provide information at your own discretion.


2.5 Your rights and choices

Access and control: You may request access to, correction of, or deletion of your personal information by contacting us at admin@theconsultinglab.us.

Communications: You can opt out of non-essential communications through your account settings or by contacting us.

Data portability: You may request a copy of your data in a portable format.


2.6 Age restrictions and COPPA compliance

Children under 13: Our services are not intended for children under the age of 13, and we do not knowingly collect personal information from them. If we discover that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information promptly.


Parental consent process: In the rare instance where we might collect information from a child under 13 (such as through supervised educational programs), we will:

  • Obtain verifiable parental consent before collecting, using, or disclosing personal information
  • Provide clear notice to parents about what information we collect and how we use it
  • Allow parents to review their child's personal information
  • Give parents the right to refuse further collection or use of their child's information
  • Allow parents to delete their child's personal information


Parental rights: Parents have the right to:

  • Review personal information collected from their child
  • Request correction or deletion of their child's information
  • Refuse to allow further collection of their child's information
  • Contact us at admin@theconsultinglab.us with any concerns


Supervised access for teens: For users ages 13-17, access should occur with appropriate supervision from parents, guardians, or educational institutions. The supervising adult accepts responsibility for the minor's use of our services.


2.7 Data retention and deletion

Retention periods:

  • Account information: Retained for the duration of your active account plus 30 days after account closure
  • Course and training data: Retained for 3 years after last access to support continuity of learning
  • Communication records: Retained for 1 year for customer service purposes
  • Payment information: Retained as required by financial regulations (typically 7 years)
  • Legal compliance data: Retained as required by applicable laws


Automatic deletion: We automatically delete or anonymize personal information when retention periods expire, except where longer retention is required by law.


User-initiated deletion: You may request deletion of your personal information at any time by contacting us at admin@theconsultinglab.us. We will process deletion requests within 30 days, subject to:

  • Legal requirements to retain certain information
  • Legitimate business needs (such as fraud prevention)
  • Technical limitations in distributed systems


Account closure: When you close your account, we will:

  • Immediately disable access to your personal information
  • Begin deletion of non-essential personal information within 30 days
  • Maintain anonymized usage statistics for service improvement


Backup systems: Personal information may temporarily persist in backup systems for up to 90 days after deletion from primary systems.



2.8 Account authenticity and compliance 

To maintain the integrity and security of TCLi Academy, all accounts must be created using a valid first and last name, accurate email address, and true identifying information. Ghost or phantom accounts are not permitted. All accounts are audited regularly for compliance. Accounts found to be in violation may be suspended or terminated without prior notice. 



2.9 International users

If you access our services from outside the United States, please be aware that your information may be processed and stored in the U.S., where privacy laws may differ from those in your jurisdiction.



Updates to this document

We may update this document periodically to reflect changes in our practices or legal requirements. When we make material changes, we will notify you through the platform or via email. The updated document will be posted on our website with the effective date noted.
